REALMZANSINAMES COMPETITION TERMS AND CONDITIONS

The Terms and Conditions set out below apply to all participants submitting entries for the Cadbury Dairy Milk #REALMZANSINAMES (“the Competition”). By entering this competition, you agree to be bound by the terms and conditions of the Cadbury Dairy Milk #REALMZANSINAMES Competition, 2024. THE PROMOTER ANDORGANISERS Cadbury Dairy Milk #REALMZANSINAMES Competition is conducted by Mondelēz South Africa Proprietary Limited, No 6 Woodmead Estate, 1 Woodmead Drive, Woodmead, Sandton, 2191, Tel: 011 253 4000 (“the Promoter”) their staff, directors, affiliated companies and third-party service providers (collectively, the “Promoter”).

Please read the Terms carefully and pay special attention to the clauses that are in bold, as they may limit our liability (responsibility) or involve some risk to you.

COMPETITION DURATION

1.1. The Competition starts at 09h00 on Monday 23 September 2024 and ends at 18h00 on Friday 27 September 2024 (Competition Period).

2. REQUIREMENTS

2.1. To qualify as an entrant into this Competition you must meet all the following:

2.1.1.be a natural person and be at least 18 (eighteen) years of age at the commencement of the Promotion Period above;

2.1.2.be a citizen and/or legal resident of the Republic of South Africa;

2.1.3.be in possession of a valid South African Identity Document, resident/work permit and/or Driver’s License; and

2.1.4.be residing or be present in South Africa for the duration of the Competition Period and for the period during which the prize draws and the delivery or collection of the prize/s takes place.

2.2 Participation in the Competition excludes directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoter or any third parties involved in the execution of the Competition, either directly or indirectly (including but not limited to agencies, organisers and/or participating stores of the Competition) as well as the members of the immediate family (being spouses, life partners, parents, children, brothers, sisters, fathers and/or mothers) and/or business partners or associates of any of the aforesaid persons.

HOW TO ENTER

3.1 To enter the competition, tune in to any of the following four (4) radio stations each day during the competition period (refer to clause 1 for the competition duration), where the station will broadcast the “Sound of the Day” daily. Participants must submit their entry via the station’s WhatsApp number by recording and sending a voice note pronouncing the name or names of the sound or letters broadcast live. By doing so, they will qualify for the random draw and stand a chance to win R4000 (four thousand rand) in cash. THE RADIO STATIONS ARE AS FOLLOWS:

3.2. To be selected as a potential winner of the R4000 (four thousand rand) cash you must record and send a voice note correctly pronouncing the name or names from the sound of the day as outlined in clause 3 above.

3.3. WhatsApp rates are in accordance with the entrant’s service provider.

3.4. A valid entry is defined as a successfully submitted voice note that respectfully pronounces a Cadbury Dairy Milk #RealMzansiNames, and has been verified by the Radio Station to which it was submitted.

3.5. Following the vetting process, the stations will select 1 (one) winner per day during the Competition Period (refer to clause 1 for the competition duration) and each winner will go live on-air with the station Presenter and will be required to pronounce the name or names that starts with the sound of the day.

3.6. There are no forms to fill in and once you meet the requirements set out in clauses 2 and 3 above, you will automatically be entered into the Competition.

3.7. Should a voice note need to be edited, a new voice note via the Station’s WhatsApp number will need to do and will be treated as a new entry into the Competition.

3.8. Where a voice recording contains multiple parties, the entrant is responsible to ensure that their consent is obtained to appear or use of their voice in any submissions for this Competition. The Promoter will not be held responsible should a dispute arise between parties where an entrant to the promotion has not followed due diligence to obtain permission to use another person’s voice note to enter the Competition.

3.9. You may enter this Competition as many times as you want, however you will not be eligible to win more than one Prize.

4. CAN I PARTICIPATE IN THE COMPETITION MORE THAN ONCE?

    4.1. Multiple entries will be permitted, subject to each entry being submitted separately   and in accordance with entry requirements.

    4.2 To the extent permitted by the Consumer Protection Act and any other applicable law:

    a) The Participant and/or winner(s) hereby indemnifies the Promoter, its associated companies, directors, officers, employees and/or agents against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the Participants entrance to the Promotion.

    b) The Promoter excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud) to the extent allowable by law.

    4.3 The Promoter reserves the right, at any time, to verify the validity of Participants (including but not limited to a Participant’s identity, age and place of residence) and to reject any Participant who has not complied with these Terms and Conditions.

      4.4 Errors and omission may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

        4.5 Neither the Promoter nor its agents or distributors will have any liability in relation to this Promotion.

        5. PRIZES

        5.1 The Competition will afford the five selected Winners per station a chance to win R4 000 in cash.

        5.2 Selected winning voice notes will be decided by the Radio Station to which it was submitted.  

        5.3 Cash prizes are non-transferable and will be paid directly to the winner by the participating radio station that selected and announced them. The prize fulfillment will be subject to the terms and conditions of that radio station.

        6. PRIZES (FULFILMENT)

        6.1 The winner/s will receive their cash prizes in accordance with the radio stations prize fulfilment dates as outlined below:  

        6.1.1 The winner (s) will be contacted by the radio station for their details.

        6.1.2 The winner (s) will receive the cash prize of R4000 cash. 

        6.2 It is the Participants responsibility to provide the correct contact number or details when entering the Competition in accordance with the radio station’s terms and conditions.

          6.3 The Promoter reserves the rights to carry out reasonable due diligence to confirm eligibility and may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities. 

            6.4 The Promoter reserves the right to withdraw the prize and/or disqualify any participant/winner that may bring the Promoter brands into disrepute. 

              6.5 Any dispute with number ownership (such as more than one individual claiming to be the owner of the same mobile/contact number – verbally or otherwise) will result in immediate disqualification of both the number and the individuals and no negotiation will be entered into. 

                        7. INDEMNITY

                        7.1 To the extent permitted by the Consumer Protection Act and any other applicable law:

                        a) The Participant and/or winner(s) hereby indemnifies the Promoter, its associated companies, directors, officers, employees and/or agents against any direct, indirect, special, incidental, consequential, or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the Participants entrance to the Promotion.

                          7.2 The Promoter reserves the right, at any time, to verify the validity of Participants (including but not limited to a Participant’s identity, age and place of residence) and to reject any Participant who has not complied with these Terms and Conditions.

                            7.4 Neither the Promoter nor its agents or distributors will have any liability in relation to this competition.

                              7.5 The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Competition will not bring the Promoter or any of the Promoter’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Competition as determined by Promoter in its sole discretion. 

                                7.6 The Promoter assumes no liability whatsoever for any entry that has been omitted from participation for any reason whatsoever.

                                  7.7 The Promoter reserves the right to delete any information uploaded by a Participant which the Promoter, in its absolute discretion, believes is illegal, obscene, offensive, or defamatory, or infringes the intellectual property rights of a third party, or is otherwise inappropriate for the Promotion. 

                                    7.8 Participants warrant that they have full rights to the voice note that they upload and that the use of the said material shall not constitute a breach of any third party’s copyright or other intellectual property rights.

                                    7.11 The Participant warrants that the entry has not been used for commercial purposes or submitted in other contests, locally or elsewhere.

                                    7.12 Each Participant agrees not to submit any entry that:

                                    a) infringes any third party’s proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, privacy, publicity, or confidentiality obligations;

                                      b) violates any applicable laws and regulations; and

                                      b) contains material which is (or promotes activities which are) obscene, discriminatory illegal offensive, threatening, profane, or harassing or which is otherwise inappropriate, in the sole discretion of the Promoter, nor may the name submitted contain any derogatory references to the Promoter or any other person or entity including brands or trademarks of the Promoter or any other person or entity.

                                      7.13 The Promoter does not assume any liability for any unlawful or unlawfully produced content entry.

                                        7.14 In the event of any inconsistency between these Terms and Conditions and any terms and conditions printed or displayed on any marketing materials published or broadcast in any media (such as but not limited to the internet, television, radio, newspaper, magazines etc.) relating to the Promotion, the terms contained in these Terms and Conditions shall prevail.

                                        CONFIDENTIALITY

                                        8.1 Participants of this Competition are voluntarily providing their personal information to the Promoter which shall be utilized for the purposes of this Competition, its associated agencies and the third-party service providers running the Competition in conjunction with the Promoter.

                                          8.2 By entering this Competition, Participants authorize the Promoter to collect personal information of Participants for the Competition purposes.

                                          DATA PROTECTION TERMS

                                          9.1 The Promoter through subcontractors/sub processors may have access to specific 

                                            9.2 Promoter through subcontractors warrants that any “Personal Information” will be collected in accordance with Protection of Personal Information Act.

                                              9.3 By accessing the Promotion, the data subject gives consent to the processor to process the Personal Information related to participation in the Competition.

                                                9.4 Personal information will be retained as long as reasonably and legally required to perform the obligations under the terms of the Promotion. 

                                                10. GENERAL 

                                                10.1The radio stations decision is final. No deliberations may be entered into and no decisions may be taken on review.

                                                10.2 The organisers will not be responsible, and disclaim any and all liability, for any loss, liability, injury, expense or damage (including direct, indirect, incidental, punitive or consequential loss) of any nature, whether arising from negligence or any other cause, which is suffered by any participant or any other third party as a result of his/her participation in this competition and/or by any action taken by the organisers or any of its affiliates in accordance with these terms and conditions.

                                                    10.3 The organisers reserve the right to vary, postpone, suspend, or cancel this competition or any aspect thereof, without notice, at any time, for any reason which the organisers deem necessary, in their sole determination.  In the event of such variation, postponement, suspension or cancellation, each participant agrees to waive any rights, interests and expectations that he/she may have in terms of this competition and acknowledge that he/she will have no recourse against the organisers.

                                                    10.4 The organisers reserve the right to disqualify any participant should the above-mentioned warranties not be complied with and/or if any other provision in the terms and conditions are not complied with.

                                                    10.5 These terms and conditions are governed by South African law and the South African courts shall have sole and exclusive jurisdiction in respect of all matters (including disputes) arising from these terms and conditions.

                                                      10.6 If any of these terms and conditions are not adhered to, your entry will be considered incomplete and will be regarded as null and void.
